BREXIT : Declaration & Titre de séjour

Brexit is on it’s way and the negotiations between Michel BARNIER (EU) and David FROST (UK) have been re-initiated for a 5 week period after a "Covid pause" …

The outcomes of the discussions are still very unclear and we may even end up with a no-deal …

Deal or no-deal, the fact that Brexit effectively happens on the 31st of December 2020 seems more and more obvious as Michael GOVE has recently announced that there will be « no extension » to the transition period. Furthermore and according to the Sunday Times, the Cabinet Office minister said that if the present transition arrangements were extended, the UK’s “ability to meaningfully put in place the measures which might help us to ensure we have an effective recovery from the Covid-19 pandemic would be less”.

In any case, the Withdrawal Agreement currently in place, plans in it’s article 27 that as far as the rights of workers and self-employed persons are concerned, qualifications should be recognized by either a « host State » or a « State of work »; this clearly means that declarations relating to UK qualifications and/or UK citizens must be accompanied by a residence application. This point has been explicitly confirmed to us by the EU Commission during our last meeting.

For UK citizens, application for residency will be possible in France through a dedicated site that french government is currently working on for early July but which mentions now that it will finally open …. early October ( link )

If the principle of residency seems to be « certain » (what is certain with BREXIT 😳 ?) «  wait & see » seems to be the only possible advice for the time being !!!
